KARNAFIT — TERMS OF USE AND LIABILITY WAIVER

1. Acceptance of Terms

By creating an account or using the KarnaFit application ("App"), you agree to be bound by these Terms of Use and Liability Waiver ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and KarnaFit.

2. Not Medical Advice

KarnaFit is a fitness guidance application only. The App, its content, workout recommendations, AI-generated suggestions, and all related features are provided for general informational and motivational purposes only.

KarnaFit is not a licensed medical provider, personal trainer, physical therapist, or healthcare professional. Nothing in the App constitutes medical advice, diagnosis, or treatment. You should never disregard professional medical advice or delay seeking it because of something you read or experienced in this App.

3. Medical Clearance — Consult Your Doctor First

Before beginning any exercise program, including any workout generated or suggested by KarnaFit, you agree to consult with a qualified physician or licensed healthcare professional to confirm you are physically fit to exercise.

This is especially important if you:

• Have a history of heart disease, high blood pressure, or cardiovascular conditions
• Have diabetes, asthma, or any chronic illness
• Are pregnant or postpartum
• Have had recent surgery or a recent injury
• Are over 40 and have not exercised regularly
• Experience chest pain, dizziness, or shortness of breath during activity

By using the App you represent that you have obtained or will obtain appropriate medical clearance before engaging in any exercise program.

4. Assumption of Risk

You acknowledge and agree that:

• Physical exercise involves inherent risks including but not limited to muscle strains, joint injuries, fractures, cardiovascular events, and death
• These risks exist regardless of the fitness level of the participant
• KarnaFit's workout recommendations are guidance only — you are solely responsible for determining whether any suggested exercise is appropriate for your individual fitness level, health status, and physical condition
• You are voluntarily choosing to participate in physical activity at your own risk
• You will not use the App to push beyond your physical limits or ignore pain, discomfort, or warning signs from your body

5. Release of Liability and Waiver

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue KarnaFit, its owners, developers, employees, contractors, affiliates, successors, and assigns (collectively "Released Parties") from any and all claims, demands, losses, damages, costs, or liabilities of any kind, whether known or unknown, arising out of or related to:

• Your use of or inability to use the App
• Any workout, exercise, or physical activity you perform while using the App
• Any injury, illness, death, property damage, or other harm sustained during or after using the App
• Any reliance on workout recommendations, AI-generated content, or guidance provided by the App

This waiver applies to claims based on negligence, strict liability, or any other legal theory.

6. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your participation in any physical activity connected to the App.

7. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied. KarnaFit does not warrant that:

• Workout recommendations are suitable for your individual needs
• The App will be error-free or uninterrupted
• Results described or implied by the App will be achieved

8. Limitation of Liability

To the maximum extent permitted by law, KarnaFit's total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim. KarnaFit shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

9. Dispute Resolution — Binding Arbitration

Any dispute arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration under the rules of the American Arbitration Association, rather than in court. By agreeing to these Terms you waive your right to a jury trial and your right to participate in a class action lawsuit.

10. Governing Law

These Terms are governed by the laws of the state in which KarnaFit is registered, without regard to conflict of law principles.

11. Changes to Terms

KarnaFit reserves the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
